Top CelebStoner Debby Goldberry and several other witnesses called by the federal government in its case against "Guru of Ganja" Ed Rosenthal in San Francisco were cited for contempt of court on May 25, 2007 for refusing to testify. Rosenthal is charged with growing and selling marijuana. He contends it was for medical purposes as allowed by the state of Caliornia and the city of Oakland, where Rosenthal lives and has been charged with conducting illegal business.
Goldsberrry held her ground when asked if she, via the Berkeley Patients Group dispensary, purchased marijuana from Rosenthal: "I decline to answer the questions. I would like to invoke my Fifth Amendment right. Furthermore, I think this prosecution is against the will of the people, against the will of the citizens, and it's actually harming the citizens of California. And I believe it would be illegal and immoral for me to participate in the prosecution because of that." Goldsberry and her fellow witnesses (including Etienne Fontan, Evan Schwartz and Brian Lundeen) are required to appear back in federal court on May 29 at 8 am. They will be given another chance to testify. If they refuse again, the court will make a decision in their regard, which could involve imprisonment. On May 29, Judge Breyer excused the seven witnesses.
