Like many fearful potheads, Andrew Grande attempted to swallow the bag as police tried to arrest him on Dec. 10 in Panama City, Florida. When he struggled, an overzealous cop tased him and soon Grande choked to death on the bag.

According to Bay County police, Grande had an argument with a girlfriend, left the car and and was apprehended in the Executive Inn parking on Front Beach Rd. at 2 am. After being tased, Grande fell to the ground. He stopped breathing and one officer did the Heimlich Manuever to no avail.

EMS were able to pull the bag out of his throat, but it was to late.

“My son shouldn’t have died that night," says Grande's mother Kathie Mauldin. "You could plainly see he was choking and no one could help him.” A nurse, Mauldin contends, “They (the deputies) need more training in the Heimlich and CPR. If they knew how to really do it, my son would still be here today.”

Bay County sheriff Frank McKeithlen counters: "This subject chose to ingest this in his mouth. Because of that he's dead."

No, Grande is dead because: 1) he attempted to swallow a plastic bag full of weed, 2) he was tased, 3) police failed to properly use the Heimlich Maneuver and 4) marijuana is illegal. Grande was 23.

I kinda agree with cwag, though I'd probably be a bit more sensitive about it since a person DID DIE, which is always sad... Myself, I'm all for the legalization of marijuana, but yes, it IS illegal still. I don't think the law itself was to blame for his death--the circumstances were unfortunate, and he ran, tried to swallow a plastic bag (which is never too smart of a decision to begin with), and he choked. I'd say both he and the police were to blame: first of all, you don't swallow a plastic bag, but at the same time if the police had correctly performed the Heimlich he might still be alive.

This is no abuse of police power. The man was breaking the law and tried to avoid being caught by swallowing a plastic bag. What kind of moron does that? Marijuana is illegal, like it or not. If you choose to break the law, and in the process of being arrested swallow plastic like a moron and die, it is not the cops' fault. It may be sad this idiot died, but it is nobody's fault but his own.
